MP HC Grants Custody of Motherless Minor to Granny, not Father

In a case of custody of a motherless minor child, the Madhya Pradesh High Court has granted custody of child to her grandmother instead of father, accepting former as a natural guardian.

Hearing the contempt and Habeas Corpus case, a division bench comprising of Justices Deepak Mishra and Ram Kishore Gupta rejected the pleas filed by Abhay Gupta asking for his 11-year-old daughter and Class V student Priyanka’s custody.

In the petition, Gupta said that after the death of his wife, his son and daughter were residing with him since 2002 but the grandmother raised the matter before the Bhopal family court and claimed the girl’s custody.

Gupta filed the petitions against the order of the family court.

The court recorded the statement of Priayanka, who was staying with her grandmother in Gujarat, in which she alleged that she expressed her willingness to stay with her grandmother and held her father responsible for her mother’s death.
