SC refused to stay the commissioner’s survey of Shri Krishna’s birthplace-Shahi Idgah in Mathura.

On Friday, the Supreme Court rejected the petition of the Muslim side and said that if there is a problem with the survey, then adopt the proper method. After this the hearing will be considered.

Allahabad High Court on Thursday had ordered a commissioner’s survey of the disputed site. Shahi Idgah Mosque and Sunni Central Waqf Board had virtually challenged this order in the Supreme Court. In this, there was a demand to stop the action of the Commissioner Survey and the High Court. The Supreme Court refused this and said that let the proceedings proceed.

On Friday, the transfer petition of all the cases of Shahi Eidgah dispute case was heard in the Supreme Court. According to the Hindu side’s advocate Mahendra Pratap Singh, the Shahi Idgah Committee has demanded that all the cases transferred to the High Court be heard in the Mathura court. A hearing regarding the same was going on in the Supreme Court. Meanwhile, the Muslim side had mentioned the High Court order and demanded a ban on the survey.

The petitioners have argued that the 1968 agreement was entered into fraudulently and is not legally valid.

The Allahabad High Court on Thursday, while accepting the petition of the Hindu side, had ordered to appoint a court commissioner for the Idgah survey. The single bench of Justice Mayank Kumar Jain gave this decision. After hearing this application on November 16, the court had reserved its decision.

After the decision of the High Court, now the Court Commissioner will survey the 13.37 acres of disputed land of Shri Krishna Janmabhoomi-Shahi Idgah. This survey will be like the Commissioner’s survey conducted in May 2021 in Gyanvapi, Varanasi. In this, the team of the Court Commissioner will go there and collect evidence and give a report to the court. What will be the method of survey? Who will be in the team? When will the survey be done? All this will be decided in the next hearing to be held in the High Court on 18 December.

The Hindu side claims that there is evidence of the existence of a temple in the Shahi Idgah Mosque, which will come to light after the survey. At the same time, the Muslim side claims that there are no such signs or evidence there. There was nothing like this there before also.
