HC Dismisses PIL against Diggy in Shopping Complex Case

Giving reprieve to former chief minister Digvijay Singh, Madhya Pradesh High Court has dismissed a PIL seeking a direction to the state to file an FIR against him for granting permission to construct a shopping complex in Indore allegedly in violation of rules, reported PTI.

The case is about permission to Kalani Builders eight years ago for building a shopping complex when Singh was chief minister of the state.

Chief justice SR Alam and justice Alok Aradhe rejected the PIL on submission of public prosecutor on behalf of the state that the petitioner and former legislature Kishore Samrite had a criminal background, report said.

In his petition, Samrite had argued that though the economic offences wing (EOW) of the state police registered a case against Singh and 10 others on February 12, 2009, it was not lodging an FIR against them, said report.

He contended that the Madhya Pradesh Housing Board scrapped an agreement it signed with Kalani Builders for construction of the complex on November 25, 2002.

In that event, the Digvijay Singh government should not have granted permission to the same builder to construct the shopping complex.

The EOW complaint includes the names of former minister Rakesh Singh, former chief secretary AV Singh, former principal secretary of the Madhya Pradesh housing and environment department UK Samal, former housing board chairman Chandraprabha Shekhar, officials Ashwin Janwade, Rakesh Sharma, PC Kulshreshta, and builders Manish Kalani and Padma Kalani, besides Singh.
