Varun Gandhi Moves SC against “Illegal Detention”

Bharatiya Janata Party’s (BJP) Lok Sabha hopeful from Pilibhit, Varun Gandhi, who is currently in jail for allegedly making hate speeches during election meetings in his constituency, on Wednesday moved Supreme Court to challenge the Uttar Pradesh government’s decision to detain him under the National Security Act (NSA).

The 29 year old Gandhi, was shifted from Pilibht to the Etah jail earlier in the day.

Appearing on Gandhi’s behalf, former additional solicitor general Mukul Rohtagi, told a bench of Chief Justice KG Balakrishnan that the youn parliamentary hopeful was being illegally detained by the state government.

The petition will now scheduled for hearing on Thursday.

Rohtagi informed the bench that he was in the process of filing a habeas corpus petition to bring Varun Gandhi to the court.

A habeas corpus special petition is filed when a person goes missing and foul play is suspected.

Varun Gandhi was arrested and later booked under the stringent NSA by the UP government for “inciting violence” prior to his arrest on Saturday.
