Omar Has No Authority to Continue, Says BJP

Citing reinstatement of Omar Abdullah and J&K Chief Minister by Governor NN Vohra as infringement of the state’s Constitution, the BJP has claimed that Omar has no authority to continue in office.

Chaman Lal Gupta, the leader of BJP legislature party in the assembly, said that the Governor, according to the constitution of the state, should have accepted the resignation of the chief minister and asked him to continue till an alternative arrangement is made for formation of a new government.

He said that Vohra, after initially accepting Omar’s conditional resignation, gave him a clean chit two days later absolving him of any involvement in the alleged sex scandal of 2006.

Omar had resigned on July 28 after PDP MLA and former Deputy Chief Minister Muzaffar Hussain Beigh claimed in the assembly that his name figured in the scandal’s suspect list.

“Once a chief minister resigns, he relinquishes his power of the government,” Gupta, a former Union minister of state for defence, said.

The Governor violated the constitutional provision by allowing Omar to continue with the same government though his resignation was of the entire government, he said adding that a new government could have been formed with the same dispensation after a detailed enquiry into the issue.

Gupta also alleged that Vohra came under pressure from the Centre and violated provisions of the constitution.

Blaming PDP for “holding the assembly at ransom and subverting democracy”, the BJP leader said that it favoured a separate assembly for the Jammu province.
