Modi Can Be Summoned in 2002 Riots Cases, Says Nanavati Commission

In a reply to Gujarat High Court’s investigation into the 2002 riots cases, the Nanavati Commission has said that the its decision not to summon Modi is not final, said media reports.

On March 22, the High Court had asked the panel to make it clear by April 1 whether it would summon Modi in the matter.

A division bench comprising of Chief Justices SJ Mukhopadhaya and Akil Kureshi asked for the information from the government pleader while hearing a plea filed by Jan Sangarsh Manch (JSM), an NGO representing the 2002 riot victims.

In September last year, the Nanavati commission had disposed of JSM’s application (which asked for summoning Modi and others) citing that it didn’t find it justifiable to cross-examine them at that point of time for the purpose stated by JSM.

Also, the panel had said that allegations JSM made in its application were vague and grounded on wrong or unwarranted assumptions.

JSM moved the High Court seeking quashing of the Nanavati Commission’s order and pleading that Modi and three others – the then home minister Gordhan Zadafia, health minister Ashok Bhat and DCP Zone 5, R J Savani – be called for cross examination with regard to the 2002 riots.
