Delhi HC Refuses Relief to Rath in Sukna Land Scam

In Sukna land scam, the Delhi High Court has refused any relief to Lt Gen PK Rath who had challenged the initiation of court of inquiry against him, said media reports.

Declining relief, a division bench led by Justice Geeta Mittal, asked Rath to move the Armed Forces Tribunal to challenged the proceedings against him, said report.

“Jurisdiction of this court is barred by Armed Forces Tribunal Act. In view of this, the petition is dismissed with liberty to petitioner to approach the tribunal,” Justice Mittal was quoted as saying.

Rath moved the high court in the wake of his indictment along with former Military Secretary Lt Gen Avadesh Prakash in the over Rs 300 crore land scam case in Darjeeling, said reports.

The Sukna scam involves the sale of 71-acres of land adjacent to Sukna military station in West Bengal for which the army had issued a no objection certificate to a private realtor.

Besides Prakash and Rath, the army probe had indicted Lt Gen Ramesh Halgali and Maj Gen P C Sen in the scam.
