SC Refuses to Entertain Plea in Sabharwal Case, Asks Son to Move HC

January 4, 2010 Visionmp.com news service

In professor Sabharwal case, the Supreme Court has declined to entertain a petition moved by Himanshu Sabharwal against acquittal of ABVP activists.

A bench headed by Justice P Sathasivam directed the petitioner to move to the appropriate High Court for the remedy instead.

The bench observed that the acquittal order of the sessions court should be challenged only in the High Court as per procedure.

Himanshu had directly moved the apex court instead of appealing in the High Court.

It may  be mentioned that Professor Sabharwal, head of the Political Science Department of Madhav College, Ujjain, died in August, 2006, after a fracas in the college over student union elections when he was allegedly beaten up by ABVP activists. Later, he succumbed to his injuries in a hospital.
