SC Hears Gax Sex; Notices to Union, Delhi Govt

In a lawsuit challenging decriminalizing gay sex, the Supreme Court has issued notices to the central government, the Delhi government and the Naz foundation seeking their opinion.

A bench comprising of Chief Justice KG Balakrishnan and Justice P Sathasivam, which issued notices on the lawsuit filed by a Delhi advocate Suresh Kaushal, sought replies of the various parties by July 20, the date of next hearing.

In his petition, Kaushal argued that the Delhi High Court’s ‘perverse ruling’ would destroy the natural balance of society.

Last Thursday, Delhi High Court, in its landmark ruling, had said that Section 377 of IPC should be amended and any sex between consenting adults should be legalized.

Section 377, a law from the British Raj era, says homosexuality and ‘unnatural sex’ is a criminal act.
