Cigarette Maker Seeks Damages, Injunction

Bhopal – Seeking a permanent injunction and damages of Rupees 10 lakh, city-based cigarette manufacturers – Lucky Tobacco Company – have filed a suit in the court of VIII ADJ, seeking a permanent injunction and damages of Rupees 10 lakh.
According to a press statement issued by the company here, all employees were complying with the instructions of a Central Excise Department team, after it showed up at the company’s Mandideep factory at around 11 am on May 14, this year.
A verbal duel, however, took place between some Muslim employees of the company and members of the Central team after the latter repeatedly refused to allow them to go to a nearby mosque for Friday prayers, which can only be performed till about 2:30 pm, it added.
The company in the release added that on repeatedly being asked for permission, the officials not only used abusive language but also slapped one of the employees and threatened to teach them a lesson.
After the team left the factory at around 4 pm, the central department officials used their clout and influence to lodge an FIR, accusing company employees of snatching away documents, their wallets and mobile phones, the release informed.
Incidentally, following the episode, the company’s licence to manufacture and market the ‘Midland’ brand of cigarettes was unilaterally cancelled by the trademark owners M/s MBM Finance and Investment, bringing it huge financial losses.
Identifying the complaint as the reason for substantial losses in its reputation, goodwill and business, the company is now seeking Rupees ten lakhs in damages and also a permanent injunction against the licencer, preventing it from canceling its licence.
